    The Board of Clinical Laboratory Personnel hereby gives notice: of the issuance of an Order regarding the Petition for Variance or Waiver, filed on July 19, 2019, by Louis K. Jean. The Notice of Petition for Waiver or Variance was published in Vol. 45, No. 144, of the July 25, 2019, Florida Administrative Register. Petitioner sought a variance or waiver of Rules 64B3-5.002 and 64B3.5.003, Florida Administrative Code, which sets forth the education, training/experience and examination requirements for licensure as a supervisor and for a specialty licensure as a medical technologist. The Board considered the instant Petition at a duly-noticed public meeting held on September 6, 2019, in Orlando, Florida. The Board’s Order, filed on October 7, 2019, denied the petition finding that Petitioner did not meet the purpose of the underlying statute by other means and that the application of the rule would not create a substantial hardship or violate the principles of fairness.
