PURPOSE AND EFFECT: The proposed revision to Children’s Medical Services Rule 64C-4.003, F.A.C., updates and reflects the CMS required standards for Diagnostic and Treatment Facilities or Services that provide care to CMS participants. This rule incorporates by reference the CMS Pediatric Cardiac Facilities Standards and the Cardiac Regional and Satellite Clinic Standards.
SUMMARY: The rule incorporates updated Standards for Diagnostic and Treatment Facilities or Services that are provided at CMS Pediatric Cardiac Facilities and Clinics.
SUMMARY OF STATEMENT OF ESTIMATED REGULATORY COSTS AND LEGISLATIVE RATIFICATION:
The Agency has determined that this will not have an adverse impact on small business or likely increase directly or indirectly regulatory costs in excess of $200,000 in the aggregate within one year after the implementation of the rule. A SERC has not been prepared by the agency.
The Agency has determined that the proposed rule is not expected to require legislative ratification based on the statement of estimated regulatory costs or if no SERC is required, the information expressly relied upon and described herein: This rulemaking will not have an adverse impact or regulatory costs in excess of $1 million within five years as established in s. 120.541(2)(a), F.S.
Any person who wishes to provide information regarding a statement of estimated regulatory costs, or provide a proposal for a lower cost regulatory alternative must do so in writing within 21 days of this notice.

(1) CMS Pediatric Cardiac Facilities. CMS Headquarters approves pediatric cardiac facilities for the CMS Network on a statewide basis upon consideration of the recommendation of the Cardiac Ssubcommittee of the CMS Network Advisory Council. CMS approved pediatric cardiac facilities must comply with the CMS Pediatric Cardiac Facilities Standards, October 2012 September 2005, which may be obtained at https://www.flrules.org/Gateway/reference.asp?No=Ref-01944. CMS approved pediatric cardiac facilities and must collect and submit quality assurance data annually in accordance with the following forms:

CMS Headquarters approves regional and satellite cardiac clinics for the CMS Network on a statewide basis upon consideration of the recommendation of the Cardiac Subcommittee of the CMS Network Advisory Council. CMS regional and satellite clinics must comply with the CMS Cardiac Regional and Satellite Clinic Standards, October 2012.
