    PURPOSE AND EFFECT: The amendment will bring the rule into compliance with the nurse licensure compact, 464.0095 F.S.

    SUMMARY OF STATEMENT OF ESTIMATED REGULATORY COSTS AND LEGISLATIVE RATIFICATION:

    The Agency has determined that this will not have an adverse impact on small business or likely increase directly or indirectly regulatory costs in excess of $200,000 in the aggregate within one year after the implementation of the rule. A SERC has not been prepared by the Agency.

    The Agency has determined that the proposed rule is not expected to require legislative ratification based on the statement of estimated regulatory costs or if no SERC is required, the information expressly relied upon and described herein: During discussion of the economic impact of this rule at its Board meeting, the Board, based upon the expertise and experience of its members and the substance of the rule amendment, determined that a Statement of Estimated Regulatory Costs (SERC) was not necessary because the rule does not impose additional rights, obligations, or duties on any persons or businesses, and that the rule will not require ratification by the Legislature. No person or interested party submitted additional information regarding the economic impact at that time.

    Any person who wishes to provide information regarding a statement of estimated regulatory costs, or provide a proposal for a lower cost regulatory alternative must do so in writing within 21 days of this notice.

    64B9-3.002 Qualifications for Examination.

    An applicant seeking certification to take the licensure examination shall submit a completed Nursing Licensure by Examination Application, form number DH-MQA 1094, 01/18 07/16, hereby incorporated by reference, and may be obtained from http://www.flrules.org/Gateway/reference.asp?No=Ref-           08265, or Nursing Licensure by Re-Examination Application, form number DH-MQA 1120, 01/1807/16, hereby incorporated by reference, and may be obtained from http://www.flrules.org/Gateway/reference.asp?No=Ref-          08266, demonstrating that he or she meets the qualifications prescribed by the Nurse Practice Act, Chapter 464, F.S. These forms are also available from the Board office or on the Board’s website: http://floridasnursing.gov. The demonstration shall include:

    (1) through (3) No change.

    (4) If the applicant is a graduate of a foreign prelicensure education program not taught in English, or if English is not the applicant’s native language, successful completion of one of the following: Successful completion of any one of the methods listed below:

    (a) A minimum score of 540 on the paper version; (207 on the computerized version, or and 76 on the internet based version), on the Test of English as a Foreign Language (TOEFL) Examination;

    (b) A minimum score of 79% on the Michigan English Language Assessment Battery (MELAB);

    (c) A minimum MELAB converted score of 79% on the Michigan Examination for the Certificate of Proficiency in English (ECPE Examination);

    (c)(d) A minimum score of 725 on Test of English for International Communication (TOEIC);

    (d)(e) A minimum score of 6.5 overall with a 7.0 on the spoken portion of on the academic version of International English Language Testing System (IELTS); or

    (e) A minimum score of 51 on the Pearson Test of English Academic (PTE Academic).

    (f) Completion of a nursing program given in English in another country;

    (g) A passing score on a nursing licensing examination which is given in English;

    (h) A certificate from the Commission on Graduates from Foreign Nursing Schools or other agency which indicates successful completion of TOEFL, TOEIC, or IELTS;

    (i) Graduation from a high school with the curriculum given in English;

    (j) Completion of a college level course for academic credit in a U.S. institution.
