The Department of Environmental Protection hereby gives notice: That it has issued an order on November 4, 2019, granting U.S. Department of the Interior, National Park Service’s Petition for a Variance. The Petition was received on August 28, 2019. Notice of receipt of this Petition was published in the Florida Administrative Register on September 13, 2019. The petition requested a variance from paragraph 62-342.700(15)(b), F.A.C., which requires that a trust fund for perpetual management of a mitigation bank be established using a form that is in substantial conformance with the form incorporated into the Rule. No public comment was received. The Order, OGC No. 19-1517 and DEP File No. 257597-005, granted the Petition to paragraph 62-342.700(15)(b), F.A.C., based on a showing that Petitioner demonstrated that a strict application of the rule would result in substantial hardship to Petitioner or would affect Petitioner differently than other similarly situated applicants and because Petitioner demonstrated that the purpose of the underlying statute will be or has been achieved by other means.
