    NOTICE IS HEREBY GIVEN that the Construction Industry Licensing Board has declined to rule on the petition for declaratory statement filed by Edward Jarriel, Jr. on September 10, 2012. The following is a summary of the agency's declination of the petition:
    The Notice of Petition for Declaratory Statement was published in Vol. 38, No. 39, of the September 28, 2012, Florida Administrative Register. The Board considered the Petition at a duly-noticed public meeting held on October 12, 2012. The Petitioner was requesting an interpretation of Chapter 489.105(3)(n), Florida Statutes, and whether the installation of Back Flow prevention devices on the consumer side of a main water distribution system for a single family dwelling is permitted under the license of an underground utility contractor. The Board’s Order, filed on November 2, 2012, denies issuance of a Declaratory Statement. Petitioner did not demonstrate he is substantially affected, as required by Section 120.565, Florida Statues. The Petitioner is a consumer inquiring about previous activity.
