    61G4-16.005: Duration of Validity

    The Construction Industry Licensing Board hereby gives notice of the issuance of an Order regarding the Petition for Variance for Manoeil Gerges, filed on August 31, 2012. The Notice of Petition for Variance was published in Vol. 38, No.39, of the September 28, 2012, Florida Administrative Register. The Board considered the Petition at a duly-noticed public meeting held on October 12, 2012, in Altamonte Springs, Florida. The Petitioner was seeking a permanent waiver or variance of Rule 61G4-16.005, Florida Administrative Code, limiting the period a passing grade is valid for purposes of certification to 4 years.
    The Board’s Order, filed on November 2, 2012, denies the Petitioner a Variance or Waiver from Rule 61G4-16.005, Florida Administrative Code, Petitioner has not shown that he would suffer a demonstrated economic technological, legal, or other type of hardship that would constitute a substantial hardship. Petitioner has not shown that application of the rule would violate principles of fairness, the Board did not further consider the Petition.
