    PURPOSE AND EFFECT: The Board proposes the rule amendment to modify the rate the Department assesses the gross amount of pilotage earned.
    SUMMARY: The rule amendment will modify the rate the Department assesses the gross amount of pilotage earned.
    SUMMARY OF STATEMENT OF ESTIMATED REGULATORY COSTS AND LEGISLATIVE RATIFICATION:
    The Agency has determined that this will not have an adverse impact on small business or likely increase directly or indirectly regulatory costs in excess of $200,000 in the aggregate within one year after the implementation of the rule. A SERC has been prepared by the agency.
    The following is a summary of the SERC:
    • The proposed change would only affect state and deputy pilots.
    • There are 11 pilot associations that will be required to comply with this rule amendment. As of October 1, 2012, there were 95 licensed state pilots in Florida and 15 licensed deputy pilots in Florida comprising the 11 pilot associations.
    • The only costs incurred by the Board of Pilot Commissioners are rule-making costs.
    • No effect on state or local revenue is expected.
    • The proposed change is not expected to impact small business, small counties or small cities.
    The Agency has determined that the proposed rule is not expected to require legislative ratification based on the statement of estimated regulatory costs or if no SERC is required, the information expressly relied upon and described herein: During discussion of the economic impact of this rule at its Board meeting, the Board, based upon the expertise and experience of its members, determined that a Statement of Estimated Regulatory Costs (SERC) was necessary and that the rule will not require ratification by the Legislature. No person or interested party submitted additional information regarding the economic impact at that time.
    Any person who wishes to provide information regarding a statement of estimated regulatory costs, or provide a proposal for a lower cost regulatory alternative must do so in writing within 21 days of this notice.

    THE FULL TEXT OF THE PROPOSED RULE IS:

     

    61G14-19.001 Percentage of Gross Pilotage Assessed.

    (1) The Department of Business and Professional Regulation shall assess the pilots in the respective ports of the state nine tenths seven tenths of one percent (.9%) (.7%) of the gross amount of pilotage earned by said pilots during each year. For the purposes of said assessment, the gross amount of pilotage earned shall be the amount of money collected by each pilot or by each entity of which the pilot is a member for piloting which shall include and not be limited to payment for piloting vessels to and from ports of this state, docking or undocking vessels, shifting vessels, running lines, delivering orders at sea, cancelled orders, boat service, detention, pilots being carried to sea, anchoring vessels, and any other related services rendered. Funds collected due under this are to be made payable to the Board and paid by the fifteenth of the following month. When received, the funds are paid into the Professional Regulation Trust Fund as created within the Department.

    (2) No change.
