The Board of Psychology hereby gives notice:

That the Board has issued an order granting the petition for variance or waiver filed by Timothy R. Smith on August 5, 2013. The following is a summary of the agency’s disposition of the petition: The Notice of Petition for Variance or Waiver was published in Volume 39, No. 164, of the August 22, 2013, Florida Administrative Register. Petitioner was seeking a variance or wavier of Rule 64B19-11.005, F.A.C. which requires that all applicants for licensure complete at least 2,000 hours of post doctoral experience under a supervisor whose supervision comports with this rule. The Board’s Order, filed on November 1, 2013, grants the Petition for Variance or Waiver on the grounds that the Petitioner has established that the purpose of the underlying statute, Section 490.005, Florida Statutes, would be met were the Petitioner to be granted a variance from the rule. In addition, the Petitioner established that the Board's application of Rule 64B19-11.005, Florida Administrative Code, to the Petitioner's circumstances would violate the principles of fairness or would impose a substantial hardship.
