The Department of Education hereby gives notice: that on September 12, 2023, the Office of the Clerk for the Department of Education, received a Petition for Variance from Rule 6A-6.03315, F.A.C., Private School Scholarship Compliance. The petition requested a variance or waiver permitting the school to provide academic instruction in a manner other than prescribed by rule, to wit, outside the school’s physical location by use of a hybrid attendance model. The petitioner is International Community School, Inc. (2504), located in Winter Park, Florida.

Notice of the petition was published in Vol. 49, No. 187, F.A.R., on September 26, 2023. Having received and reviewed public comment on the petition, an Order of Denial was executed on November 3, 2023. Specifically, the Department’s Order of Denial finds that the Petitioner failed to demonstrate substantial hardship, violation of principles of fairness, or satisfaction of purpose of the rule’s underlying statutes by other means, and therefore does not merit issuance of the requested variance or waiver.
