SUMMARY: This emergency rule describes the on-line game “25th Anniversary MILLIONAIRE RAFFLE™, for which the Department of the Lottery will sell tickets beginning November 9, 2012.

THE FULL TEXT OF THE EMERGENCY RULE IS:

53ER12-73 25th Anniversary MILLIONAIRE RAFFLE™.

(1) 25th Anniversary MILLIONAIRE RAFFLE™ is a number-match game with a limited number of tickets available that will be sold within a limited sales period.

(2) Each 25th Anniversary MILLIONAIRE RAFFLE (“MILLIONAIRE RAFFLE”) ticket sells for $20.

(3) MILLIONAIRE RAFFLE tickets will go on sale Friday, November 9, 2012.  Sales of MILLIONAIRE RAFFLE tickets will cease immediately after the 1,000,000th ticket is sold or at midnight on December 30, 2012, whichever occurs first. 

(4) Each MILLIONAIRE RAFFLE ticket will contain a unique ticket number that will be automatically entered into one of six random computerized weekly drawings based on the date it is purchased. Tickets purchased by December 23, 2012, will also be entered into the grand prize drawing on December 31, 2012, unless previously selected as a $1,000,000 winner in a weekly drawing.  Tickets purchased after December 23, 2012, will only be included in the grand prize drawing.  The drawing schedule is as follows:

(5) The prizes, number of winners and estimated odds in each of the six weekly drawings and the grand prize drawing are as follows:

* The estimated odds are if MILLIONAIRE RAFFLE tickets are sold proportionally throughout the 25th Anniversary MILLIONAIRE RAFFLE sales period and if all MILLIONAIRE RAFFLE tickets are sold. The actual odds of winning a weekly prize depend upon the number of tickets sold for each weekly drawing.

**The estimated odds of winning a prize in the grand prize drawing are if all MILLIONAIRE RAFFLE tickets are sold.

(6) MILLIONAIRE RAFFLE tickets will automatically print from the terminal with ticket numbers issued in sequential order from 0000001 to 1000000 as they are sold throughout the state. Each MILLIONAIRE RAFFLE ticket will contain only one ticket number. Players cannot select their own ticket numbers.

(7) MILLIONAIRE RAFFLE tickets cannot be cancelled.

(8) 25TH Anniversary MILLIONAIRE RAFFLE Drawings.

(a) Weekly Drawings.  In each weekly drawing, only tickets purchased during the corresponding sales period will be included in the drawing.  The 1st number drawn will win the first prize. The 2nd through the 51st numbers drawn will win a second prize and will serve as alternates, in the order drawn, for a first prize in the event the $1,000,000 prize is not claimed within the 180-day claim period.  A total of 306 weekly drawing prizes will be awarded.

1. In the event that all 1,000,000 MILLIONAIRE RAFFLE tickets sell out during a weekly drawing sales period in which there are fewer tickets in the weekly drawing than weekly prizes to be awarded, a two-part drawing for that weekly sales period will be held on the date scheduled. Part one of the drawing will include only those tickets sold during the sales period and prizes will be awarded in the order tickets are drawn.  Any remaining prizes will be awarded in part two of the drawing which will include all 1,000,000 tickets, excluding tickets selected for prizes in part one of the drawing and tickets selected as $1,000,000 prize winners in previous weekly drawings. The remaining prizes in part two of the drawing will be awarded in the order tickets are drawn. The overall odds of winning a prize in part one of the drawing are 1:1.  The overall odds of winning a prize in part two of the drawing are (51 minus the number of prizes awarded in part one of the drawing) in (1,000,000 minus the number of winners in part one of the drawing and minus the number of $1,000,000 prizes in the previous weekly drawings). 

2. In the event that all 1,000,000 MILLIONAIRE RAFFLE tickets sell out and there are no ticket sales during a weekly sales period, the prizes for that sales period will be awarded in a drawing on the date scheduled. The drawing will include all 1,000,000 MILLIONAIRE RAFFLE tickets, excluding tickets selected as $1,000,000 prize winners in previous weekly drawings, and the prizes will be awarded in the order tickets are drawn. The overall odds of winning a prize are 51 in (1,000,000 minus the number of $1,000,000 prizes in the previous weekly drawings).

(b) Grand Prize Drawing. In the grand prize drawing, all 1,000,000 tickets, excluding the $1,000,000 weekly prize winners, will be included in the drawing. The 1st number drawn will win the first prize. The 2nd through the 11th numbers drawn will win a second prize and will serve as alternates, in the order drawn, for the first prize in the event the first prize is not claimed within the 180-day claim period. The 12th through the 61st numbers drawn will win a third prize and the 62nd through 561st numbers drawn will win a fourth prize.  No alternates will be drawn for the second, third or fourth prizes. A total of 561 prizes will be awarded in the grand prize drawing.

(9) 25th Anniversary MILLIONAIRE RAFFLE drawings shall be public, held in Tallahassee, Florida, and witnessed by an accountant employed by an independent certified public accounting firm. Winning numbers will be available after each drawing on the Florida Lottery’s website at flalottery.com. The top prize winning number will be available after each drawing at Florida Lottery retailers.

(10) Upon validation of a winning MILLIONAIRE RAFFLE ticket in a weekly drawing, the terminal will produce “player claim instructions” and a “continuation ticket” for the grand prize drawing. The MILLIONAIRE RAFFLE continuation ticket automatically issued for the claimant shall be the instrument from which a claim on the grand prize drawing or any subsequent weekly drawing occurring after a sellout will be paid. MILLIONAIRE RAFFLE tickets and MILLIONAIRE RAFFLE continuation tickets are the only valid receipts to redeem a prize. 

(11) Winning MILLIONAIRE RAFFLE tickets valued at $1,000, $10,000 and $100,000 must be presented to a Florida Lottery office for payment. Winning MILLIONAIRE RAFFLE tickets valued at $1,000,000 and $2,000,000 must be presented at Lottery headquarters for payment. Information about procedures for filing a claim can be obtained at flalottery.com or by calling [phone] (TDD [phone]). 

(12) 25th Anniversary MILLIONAIRE RAFFLE prizes must be claimed within 180 days from the date of the drawing.

(13) If a winning MILLIONAIRE RAFFLE ticket for a prize of $2,000,000 or $1,000,000 is not presented to a Florida Lottery office for payment within 180 days from the date it was drawn, an alternate prizewinner who has claimed his or her prize within the 180-day claim period will be used as set forth in paragraph (8)(a) or (b), as applicable, to award the unclaimed prize. The Florida Lottery will attempt to notify the first alternate for a period of two weeks.  If the Florida Lottery is unable to contact the first alternate within the two week period, the Florida Lottery will attempt to notify the second alternate. This process will continue until an alternate is contacted or the Florida Lottery has exhausted the list of available alternates, in which case the unclaimed prize will not be awarded.  An alternate winner will be awarded the difference between the greater prize and the lesser prize.

(14) From Friday, November 9, 2012, through midnight on December 30, 2012, MILLIONAIRE RAFFLE tickets will be available for purchase daily between the hours of 6:00 a.m. and midnight, subject to a retailer’s hours of operation, on-line system availability and MILLIONAIRE RAFFLE ticket availability, 

(15) Players must be at least 18 years of age. Persons prohibited by Section 24.116, Florida Statutes, from purchasing a Florida Lottery ticket are not eligible to play.

(16) All 25th Anniversary MILLIONAIRE RAFFLE prizes are subject to the provisions of Chapter 24, Florida Statutes, and rules promulgated thereunder.  Prizes will be paid in accordance with the rule of the Florida Lottery governing payment of prizes. A copy of the current prize payment rule can be obtained from the Florida Lottery, Office of the General Counsel, 250 Marriott Drive, Tallahassee, Florida 32399-4011.

(17) Payment of all federal, state and/or local taxes will be the responsibility of the winner. Federal withholding taxes will be deducted from $2,000,000, $1,000,000, $100,000 and $10,000 cash prize payments.
