SUMMARY: This emergency rule describes the 25th Anniversary MILLIONAIRE RAFFLE™ Retailer Bonus Commission Promotion in which the Florida Lottery will award a bonus commission to retailers that sell top prize winning 25th Anniversary MILLIONAIRE RAFFLE tickets.

53ER12-74 25th Anniversary MILLIONAIRE RAFFLE™ Retailer Bonus Commission Promotion.

(1) Beginning Friday, November 9, 2012, the Florida Lottery will conduct the 25th Anniversary MILLIONAIRE RAFFLE™ Retailer Bonus Commission Promotion.  Retailers selling 25th Anniversary MILLIONAIRE RAFFLE tickets that win the top prize of $1 million in cash in a weekly drawing or $2 million in cash in the grand prize drawing will receive a bonus commission of $5,000. A total of seven $5,000 retailer bonus commissions will be awarded.  The 25th Anniversary MILLIONAIRE RAFFLE sales periods and drawing schedule are as follows:

(2) Sales of 25th Anniversary MILLIONAIRE RAFFLE tickets will cease immediately after the 1,000,000th ticket is sold or at midnight on December 30, 2012, whichever occurs first.

(3) In the event that all one million MILLIONAIRE RAFFLE tickets are sold out before all weekly drawing prizes have been won, all raffle tickets, except $1,000,000 winners from previous drawings, will be included in the weekly drawing(s) to award the remaining prizes.

(4) Retailers will receive their bonus commission checks within two weeks of each of the 25th Anniversary MILLIONAIRE RAFFLE drawings.

(5) Award of a bonus commission is not dependent upon the winning 25th Anniversary MILLIONAIRE RAFFLE ticket being claimed by the winner. Retailers who sell second prize winning tickets that subsequently become alternate winners of a $1 or $2 million prize will not be awarded the bonus commission.

(6) Retailers whose Florida Lottery contracts are terminated or inactivated prior to the bonus commission shall be paid the bonus commission provided the termination or inactivation was not due to non-compliance with Florida Lottery laws, rules or contract terms.

(7) A bonus commission will be considered compensation to the retailer for Internal Revenue Service purposes. The Florida Lottery reserves the right to apply a bonus commission earned against a retailer’s outstanding debt to the Florida Lottery, and to award the remaining balance of the bonus commission, if any.
