    PURPOSE AND EFFECT: The rule is being amended to update a form which is incorporated by reference in subsection (1)(b) of the rule. CE Form 50 is being amended for greater clarity and to incorporate certain stylistic changes.

    SUMMARY: This rulemaking affects CE Form 50, which is the Commission's complaint form. In particular, the amended complaint form: (1) expands the instructions included with the form by detailing the purpose for each of the form's sections, explaining the Commission's jurisdiction, describing the applicable statute of limitations, and discussing more fully the circumstances in which a complaint could trigger an award of costs and attorney's fees; (2) shortens language about filing one complaint per respondent; (3) eliminates specific references to the Sunshine Amendment and Code of Ethics, substituting instead the phrase "ethics law"; (4) rephrases language concerning the submission of media materials; and (5) asks that the complaint not include voluminous exhibits or copies of statutes.

    SUMMARY OF STATEMENT OF ESTIMATED REGULATORY COSTS AND LEGISLATIVE RATIFICATION: The Agency has determined that this will not have an adverse impact on small business or likely increase directly or indirectly regulatory costs in excess of $200,000 in the aggregate within one year after the implementation of the rule. A SERC has not been prepared by the Agency.

    The Agency has determined that the proposed rule is not expected to require legislative ratification based on the statement of estimated regulatory costs or if no SERC is required, the information expressly relied upon and described herein: based on past experiences with rules of this nature, the adverse impact or regulatory cost, if any, do not exceed and would not be expected to exceed any one of the economic criteria set forth in Section 120.541(2)(a), F.S.

    Any person who wishes to provide information regarding a statement of estimated regulatory costs, or provide a proposal for a lower cost regulatory alternative must do so in writing within 21 days of this notice.
