    NOTICE OF CORRECTION

    Notice is hereby given that the following correction has been made to the proposed rule in Vol. 45 No. 88, May 6, 2019 issue of the Florida Administrative Register.

    The Agency received a lower cost regulatory alternative (LCRA) after the proposed rule published including health care clinic licensure requirements for specific providers, pursuant to Part X of Chapter 400, Florida Statutes (F.S.). The Agency prepared a statement of estimated regulatory costs (SERC), in accordance with section 120.541, Florida Statutes (F.S.).

    SUMMARY OF STATEMENT OF ESTIMATED REGULATORY COSTS AND LEGISLATIVE

    RATIFICATION: Rule 59G-1.060 establishes requirements for providers who wish to enroll, or maintain enrollment, in the Florida Medicaid program; enrollment in Florida Medicaid is voluntary. Good faith estimates prepared by the Agency indicate that 32,302 providers currently enrolled in Florida Medicaid are required to comply with Health Care Clinic licensure requirements pursuant to Part X of Chapter 400, F.S. The potential cost for those providers who choose to enroll or maintain enrollment with Florida Medicaid is estimated at $100 every two years for an aggregate total of no more than $300 over five years.

    The Agency has determined that this rule will not have an adverse impact on small business or likely increase, directly or indirectly, regulatory costs in excess of $200,000 in the aggregate within one year after the implementation of the rule. Based upon this information and pursuant to section 120.541, F.S., the rule will not require legislative ratification. The Agency rejected the LCRA submitted by the Florida Association for Behavioral Analysis (FABA) because enrollment in the Florida Medicaid program is voluntary.  Upon enrollment, providers agree to comply with all local, state, and federal laws, including rules, regulations, and statements of policy applicable to the Florida Medicaid program as stated in the Florida Medicaid Provider Handbooks and Policies issued by AHCA.
