NOTICE IS HEREBY GIVEN that on August 22, 2006, the Florida Real Estate Appraisal Board has issued an order.
The Florida Real Estate Appraisal Board hereby gives notice that it has issued an Order on the Petition for Variance/Waiver, which was filed on May 9, 2006 by Ben Faulk. The Notice of Petition for Variance/Waiver was published in Volume 32, No. 22, of the June 2, 2006, Florida Administrative Weekly. The Petitioner sought a Variance/Waiver with regard to requirements under Rule 61J1-6.001, F.A.C., entitled Experience Requirement, governing how to account for appraiser experience. His verification submitted was from a former, not current, supervisor. The Florida Real Estate Appraisal Board considered the Petition at its meeting held on August 7, 2006, in Orlando, Florida. The Board's Order, filed on August 22, 2006, denied the Petition for waiver of Rule 61J1-6.001, F.A.C., finding that Petitioner failed to demonstrate evidence of a substantial hardship, or a violation of the principle of fairness or that the underlying purposes of the relevant statutes will be or have been achieved by other means.
