Board of MedicineThe Board of Medicine hereby gives notice that it has received a Petition for Declaratory Statement filed on behalf of Charles Goldsmith, M.D., and Lawrence Schimmel, M.D., on October 24, 2007. The Petitioners seek the Board’s opinion as to the applicability of Section 458.331(1)(i), Florida Statutes, as it applies to Petitioner. The Petitioners seek the Board’s interpretation with regard to whether the business and investment arrangements outlined in the Petition violate the Florida Patient Self-Referral Act, as set forth in Section 456.053, F.S., or the physician fee-splitting provision, as set forth in Section 458.331(1)(i), F.S. The Board will consider this petition at its meeting scheduled for December 1, 2007, in Orlando, Florida.
