McDowell, Esquire, Bilzin Sumberg Baena Price & Axelrod, on behalf of.SBR-Fortune Associates, LLLP, on October 16, 2007. The petition seeks the agency’s opinion as to whether pursuant to Section 163.180(2)(b), Florida Statutes, a new development, which constructs and dedicates public park and recreation facilities prior to the issuance of a Certificate of Occupancy in excess of the amount necessary to serve the new development pursuant to the legal government’s adopted level of service, meet the requirements for park and recreation concurrency.
