The Bureau of Elevator Safety hereby gives notice that it issued an Order Granting Emergency Variance Request on November 17, 2006 in response to a petition filed on October 4, 2006, by David Luciano regarding Harris Music Loft, License Number 5608 and advertised in F.A.W. Vol. 32, No. 42. The petition sought a waiver from Rules 2.7.3.2 and 2.7.3.3, ASME A17.1, 2000 Edition as adopted by Chapter 3001.2, 2004 Florida Building Code requesting to use a vertical ladder as a means of access to the machine room from the roof. The petition was granted because the proposed configuration was a significant improvement over the existing situation and the cost of making the access totally code compliant would be prohibitive.
