    NOTICE OF CHANGE

    Notice is hereby given that the following changes have been made to the proposed rule in accordance with subparagraph 120.54(3)(d)1., F.S., published in the October 27, 2014 issue of the Florida Administrative Register, Volume 40, Number 209, pages 4771-4773. The changes are made in response to written and oral comments from the Joint Administrative Procedures Committee or as the result of staff recommendations that were discussed at an adoption hearing held on November 19, 2014. Two of the maps incorporated by reference in subsection 62-302.532(3), F.A.C., are updated to reflect the addition of Judges Bayou to the Upper Escambia Bay Estuarine Nutrient Region and to correct the numbering of estuarine segments for the St. Marys River Estuarine Nutrient Region. The proposed rule has changed so that when it is adopted it will read:

Criteria expressed as annual means are arithmetic means and are not to be exceeded more than once in a three year period. For criteria expressed as the long-term average of annual means, the long-term average shall be based on data from the most recent seven-year period and shall not be exceeded.  Nutrient and nutrient response values do not apply to tidally influenced areas that fluctuate between predominantly marine and predominantly fresh waters during typical climatic and hydrologic conditions.

    9. Alafia River Estuary
