NOTICE IS HEREBY GIVEN that The Florida Real Estate Commission has issued an order disposing of the petition for declaratory statement filed by Climer School of Real Estate on September 9, 2015. The following is a summary of the agency’s disposition of the petition:
The Notice of Petition for Declaratory Statement was published in Vol. 41, No. 183, of the September 21, 2015, Florida Administrative Register. The Commission considered the Petition at a duly-noticed public meeting held on October 20, 2015. The Petitioner sought the Commission’s opinion regarding whether the probable cause panel properly dismissed their complaint which alleged that a competitor used the trade name of “The Climer School of Real Estate” in their advertising, and by doing so, the competitor directed consumers to their school. The Commission denies the petition because the petition for declaratory statement should not be used to determine the conduct of another person or where the conduct complained about has already occurred.
