    61G4-16.005: Duration of Validity

    The Construction Industry Licensing Board hereby gives notice of the issuance of an Order regarding the Petition for Variance and Waiver filed by Masaaki Yamaoto, on August 22, 2012. The Notice of Petition for Variance and Waiver was published in Volume 38, No. 39, of the September 28, 2012, Florida Administrative Register. The Board considered the Petition at a duly-noticed public meeting held on October 12, 2012. The Petitioner is seeking a permanent waiver or variance of Rule 61G4-16.005, F.A.C., limiting the period a passing grade is valid for purposes of certification to 4 years.
    The Board’s Order, filed on November 14, 2012, denies the Petition for Wavier and Variance of Rule 61G4-16.005, Florida Administrative Code. The Petitioner has not shown that Petitioner would suffer a demonstrated economic, technological, legal, or other type of hardship that would constitute a substantial hardship or that application of the rule would violate principles of fairness.
