The Board of Clinical Social Work, Marriage and Family Therapy, and Mental Health Counseling hereby gives notice:

of the issuance of an Order regarding the Petitioner for Variance or Waiver submitted by Anisa Mitchell, LCSW, on July 24, 2019. The Notice was published in Volume 45, No. 158, of the Florida Administrative Register, August 14, 2019. Petitioner seeks a variance or waiver of paragraph 64B4-6.002(1)(e) and subsection 64B4-6.002(2), F.A.C., from the rules requirement that a licensee may obtain continuing education credit for only those hours obtained from a Board approved continuing education provider. The Board considered the Petition at its meeting held on August 15, 2019 in Orlando, Florida. The Board’s Order, filed on September 11, 2019, grants the petition for variance and waiver finding that the Petitioner met the purpose of the underlying statute by other means and that application of the rule at issue to Petitioner would violate principles of fairness or cause a substantial hardship. The Board agreed to grant Petitioner’s request, in part, and granted her 23 hours of continuing education for her attendance at the World Parkinson Congress.
