    NOTICE IS HEREBY GIVEN that the Division of Florida Condominiums, Timeshares, and Mobile Homes, Department of Business and Professional Regulation, State of Florida, has received the petition for declaratory statement from Donald H. Johnson, In Re: Wells Landing Homeowners Association, Docket No. 2016055382, filed on November 23, 2016. The petition seeks the agencys opinion as to the applicability of Section 718.112(2)(a)1. and Section 720.306(9)(a), Florida Statutes, as it applies to the petitioner.

    Whether the Association is required to elect five board members pursuant to Section 718.112(2)(a)1., Florida Statutes, or elect the number of board members provided for in the Association’s governing documents pursuant to Section 720.306(9)(a), Florida Statutes?
