    SECOND NOTICE OF CHANGE

    Notice is hereby given that the following changes have been made to the proposed rule in accordance with subparagraph 120.54(3)(d)1., F.S., published in Vol. 41 No. 187, September 25, 2015 issue of the Florida Administrative Register. The Joint Administrative Procedures Committee, in a letter dated December 9, 2015, indicated that the Notice of Change published in Vol. 41 No. 236, December 8, 2015, issue of the Florida Administrative Register incorrectly stated the publication information of the proposed rule as Vol. 41, No. 156, August 12, 2015.  The correct publication date is stated above. The Notice of Change also failed to make a necessary substantive change to subsection (8) of the rule and include a law implemented as follows:

     

    64K-1.005 Privacy of Controlled Substance Prescription Dispensing Information.

    (1) through (7) No change.

    (8) Agency administrators shall provide a quarterly report to the pProgram manager with the status of each active investigation case which has required program database access. The report shall include, at a minimum, whether the case is active or inactive and the disposition, if applicable.
