PURPOSE AND EFFECT: The purpose of the proposed new rules is to establish the requirements for carbon monoxide sensor devices as required under subsection 509.211(4), F.S., for public lodging establishments that contain a boiler regulated under Chapter 554, F.S. Rule 69A-70.005, F.A.C., will adopt the National Fire Protection Association (NFPA) code, NFPA-720-2012 edition, as the standard for carbon monoxide detectors in spaces or rooms of public lodging establishments that contain a boiler regulated under Chapter 554, F.S. Rule 69A-70.010, F.A.C., additionally requires labeling and compliance with Underwriters Laboratories, Standard 2034. An inspection certification process is also imposed.

69A-70.001 Scope.
(1) The rules contained in this chapter shall establish the installation requirements for carbon monoxide sensor devices as required under subsection 509.211(4), F.S., for public lodging establishments that contain a boiler regulated under Chapter 554, F.S.

69A-70.005 Codes Adopted.
The Department of Financial Services hereby adopts and incorporates by reference the following National Fire Protection Association (NFPA) code as to the installation of carbon monoxide detectors:
(1) NFPA 720-2012 edition, Standard for the Installation of Carbon Monoxide (CO) Detection and Warning Equipment.
(2) Underwriters Laboratories, Inc., Standard 2034.

69A-70.010 Installation Requirements.
(1) Where required by subsection 509.211(4), F.S., the installation of carbon monoxide sensor devices shall comply with the requirements of NFPA 720 as adopted in Rule 69A-70.005, F.A.C.
(2) Sensor devices shall bear the label of a nationally recognized testing laboratory having been tested and listed as complying with the most recent Underwriters Laboratories, Inc., Standard 2034, as adopted in Rule 69A-70.005, F.A.C.
(3) Requirements of this section are in addition to the requirement imposed by subsection 509.211(4), F.S., that devices shall be integrated with the public lodging establishment’s fire detection system.
(4) Business owners having boilers required to be inspected in accordance with The Boiler Safety Act, Chapter 554, F. S., must submit a completed “Certificate of Carbon Monoxide Alarm Installation” Form, DFS-K3_xxxx, signed by a state-licensed alarm system contractor or a certified electrical contractor indicating the required detector has been installed and has been integrated with the public lodging establishment’s fire detection system.
