NOTICE OF CHANGE
Notice is hereby given that the following changes have been made to the proposed rule in accordance with subparagraph 120.54(3)(d)1., F.S., published in Vol. 40, No. 201, October 15, 2014 issue of the Florida Administrative Register.
The changes are in response to written comments submitted by the staff of the Joint Administrative Procedures Committee. The changes are as follows:
1. 61G4-17.001(1)(m) shall now read:
(m) Section 489.129(1)(m), F.S.: Misconduct or incompetency in the practice of contracting, shall include, but is not limited to:
1. Failure to honor a warranty.

$1,000 fine and/or probation or suspension.
$2,500 fine and/or probation or suspension.
$5,000 fine and/or probation or suspension.
$10,000 fine and revocation.
2. 61G4-17.001(1)(n) shall now read:
(n) Section 489.129(1)(n), F.S.: Committing Being found guilty of gross negligence, repeated negligence, or negligence resulting in a significant danger to life or property.

$3,000 $1,000 fine and probation, suspension or revocation.
$10,000 $3,000 fine and suspension or revocation.

3. 61G4-17.001(1)(p) shall now read:
(p) Section 489.129(1)(p), F.S.: Intimidating, threatening, coercing, or otherwise discouraging the service of a notice to owner under part 1 of Chapter 713 or a notice to contractor under Chapter 255 or part 1 of pursuant to Chapter 713, F.S.."
