    64B13-4.001: Examination Requirements

    NOTICE IS HEREBY GIVEN THAT on November 6, 2009, Board of Optometry has issued an order to Grant on the Petition for Variance or Waiver filed on September 24, 2009, by Mona Patel, O.D. The Notice of Petition for Variance or Waiver was published in Vol. 35, No. 40, October 9, 2009, Florida Administrative Weekly. The petitioner sought a variance from the provision of subsection 64B13-4.001(1), Florida Administrative Code, which requires applicants for licensure to obtain a passing score on the examination given by the National Board of Examiners in Optometry (NBEO) within five years of applying to take the Florida state examination described in subsection 64B13-4.001(2), F.A.C. Petitioner passed the NBEO examination in May, 2004, which is less than 6 months outside the requirement. The Board of Optometry considered the Petition at its meeting held on October 30, 2009 in Lake Buena Vista, Florida. The Board’s Notice of Intent to Grant, filed on November 6, 2009, determined that the Petitioner has demonstrated that the purpose of the underlying statute is met, and application of the rule would create a substantial hardship. For these reasons, the Petition for Variance or Waiver was granted.
