The Florida Department of State, Division of Library and Information Services, hereby gives notice that it is denying the Charlotte County Board of Commissioners’ Petition for Variance of paragraph 1B-2.011(2)(b), F.A.C., filed on September 20, 2013. Notice of this Petition was published in the Florida Administrative Register on September 28, 2013, in Vol. 39, No. 190. The Order denying the Petition was executed and filed on December 18, 2013. The Petition was denied because Charlotte County did not demonstrate that granting the requested variance and allowing library facilities, constructed with state funds, to be used for non-library purposes would achieve the purpose of the underlying statutes.
