    NOTICE OF CHANGE
    Notice is hereby given that the following changes have been made to the proposed rule in accordance with subparagraph 120.54(3)(d)1., F.S., published in Vol. 37 No. 41, October 14, 2011 issue of the Florida Administrative Weekly.

    In Volume 1- Automated Student Information the following changes were made to address comments of the Joint Administrative Procedures Committee.

    Data Element 101325, Code O, M, and Q were corrected as follows:

            O Fee Exempt: The student is or was at the time he or she reached 18 years of age in the custody of a relative under s. 39.5085 or was adopted from the Department of Children and Family Services after May 5, 1997. Such exemption includes fees associated with enrollment in career-preparatory instruction. The exemption remains valid until the student reaches 28 years of age. (1009.25(1)(d), F.S.) The student was adopted from the Department of Children and Family Services after May 5, 1997 as per s. 1009.25(2)(c), F.S.

            M Fee Exempt: The student is or was at the time he or she reached 18 years of age in the custody of the Department of Children and Family Services or, after spending at least 6 months in the custody of the department after reaching 16 years of age, was placed in a guardianship by the court. Such exemption includes fees associated with enrollment in career-preparatory instruction. The exemption remains valid until the student reaches 28 years of age. (1009.25(1)(c)) a recipient of a Road-to-Independence Scholarship, or is or was at the time he or she reached 18 years of age in the custody of a relative under s. 39.5085, F.S. and s. 1009.25(2)(d).

            Q Fee Exempt: The student is enrolled in a dual enrollment or early admission program pursuant to Section 1007.27 or Section 1007.271 (1009.25(1)(a), F.S. and has taken the basic skills assessment within the first six weeks of enrollment (1009.25(2)(a); 1007.271).

    Data Element 108791, Code 364 was corrected to read:

            364 Postsecondary career and technical education instruction under the Course Code Directory seven-digit codes assigned to applied technology diploma programs/courses. Section 1004.02(8), F.S. In accordance with 1011.80(10), a dual enrolled student (1004.91 F.S.) is not eligible for workforce development funding unless the student has completed the basic skills assessment (1007.271(2), F.S.)

    Data Element 173400, Code Z was corrected to read:

            Note: Section 504 of the Rehabilitation Act of 1973 provides that: “No handicapped person shall, on the basis of handicap, be excluded from participation in, be denied the benefits of, or otherwise be subjected to discrimination under any program or activity which receives or benefits from Federal financial assistance.” (34 USC s. 104.4) is a civil rights statute which provides that: “No otherwise qualified individual with handicaps in the United States...shall, solely by reason of his/her handicap, be excluded from the participation in, be denied the benefits of, or be subjected to discrimination under any program or activity receiving federal financial assistance or activity conducted by any Executive agency or by the United States Postal Service.” (29 USC s. 794)
