    NOTICE OF CHANGE

    Notice is hereby given that the following changes have been made to the proposed rule in accordance with subparagraph 120.54(3)(d)1., F.S., published in Vol. 47 No. 208, October 26, 2021 issue of the Florida Administrative Register.

    The following changes were precipitated by comments received from the Joint Administrative Procedures Committee on November 4, 2021.

     

    33-404.103 Mental Health Services – Definitions.

    (1) through (5) No Change.

    (6) “Critical Event” – involvement of an inpatient inmate in one or more of the following events or behaviors: receipt of a disciplinary report, assignment to self-harm observation status after committing an act of self-injury, homicide, attempted homicide, escape, attempted escape, physical or sexual assault or battery, or attempted physical or sexual assault or battery.

    (7) through (18) No Change.

    FORM UPDATE SUMMARY

    In addition to the updates above, the following list provides a summary of the updates made to Forms incorporated by reference:

     

    Form DC6-2087

    1. The language in the instructions section of the form has been changed to remove duplicative language associated with the receipt of a disciplinary report. This language is now included in the change to the definition of “critical event.” The new instructions language within the form reads as follows:

     

    Instructions: Risk assessment for inpatient treatment is to be completed on each inmate (after review of record) as follows – initial within three business days of CSU admission and seven business days of CMHTF or TCU admission, every 90 days thereafter, and within three business days of an occurrence of a critical event. The original is to be filed in the classification file, a copy provided to the RAT leader, and a copy in the inpatient record in the “Other Documents” section.
