NOTICE IS HEREBY GIVEN that the Office of Early Learning has declined to rule on the petition for declaratory statement filed by Eric B. Epstein, Esq. on behalf of Scholar Tots, Inc. d/b/a Children’s Learning Academy on September 25, 2015. The following is a summary of the agency’s declination of the petition:

The Notice of Petition for Declaratory Statement was published in Volume 41, No. 191, of the October 1, 2015 Florida Administrative Register. The petition sought a declaratory statement from the Office regarding the validity of agency action with respect to VPK provider readiness rates and the petitioner’s status as a provider on probation. On December 21, 2015, the Office issued a Final Order denying the Petition for Declaratory Statement stating that the issue raised by the petition is more appropriately addressed under section 120.56, F.S.
