    PURPOSE AND EFFECT: The purpose and effect of the prosed rule amendment is to repeal rules identified during the comprehensive rule review required by Executive Order 11-211 as duplicative, unnecessarily burdensome, or no longer necessary.

    SUMMARY: Rule 62-296.700, F.A.C., requires certain existing emissions units located in a particulate matter (PM) air quality maintenance area or in the area of influence of such an air quality maintenance area to meet specified PM emission limits. Rule 62-204.340, F.A.C., provides that portions of Duval and Hillsborough counties are PM air quality maintenance areas. Rules 62-296.701 through 62-296.712, F.A.C, provide the source category-specific PM emission limits that facilities located in these PM maintenance areas must meet. Rules 62-296.701, 62-296.703, 62-296.706, 62-296.709, and 62-296.710, F.A.C., provide PM emission limits for five source categories: Rule 62-296.701, F.A.C., provides PM emission limitations for Portland Cement plants; Rule 62-296.703, F.A.C., provides PM emission limitations for carbonaceous fuel burning equipment; Rule 62-296.706, F.A.C., provides PM emission limitations for glass melting furnaces; Rule 62-296.709, F.A.C., provides PM emission limitations for lime kilns; and Rule 62-296.710, F.A.C., provides PM emission limitations for smelt dissolving tanks. These five rules are being repealed because the facilities that were subject to these rules no longer exist. Rules 62-296.701, 62-296.703, 62-296.706, 62-296.709, and 62-296.710, F.A.C., are cross-referenced in Rules 62-296.700 and 62-296.712, F.A.C., but the repeals will not impact Rules 62-296.700 and 62-296.712, F.A.C., as the facilities subject to those cross-references no longer exist.

    SUMMARY OF STATEMENT OF ESTIMATED REGULATORY COSTS AND LEGISLATIVE RATIFICATION:

    The Agency has determined that this will not have an adverse impact on small business or likely increase directly or indirectly regulatory costs in excess of $200,000 in the aggregate within one year after the implementation of the rule. A SERC has not been prepared by the Agency.

    The Agency has determined that the proposed rule is not expected to require legislative ratification based on the statement of estimated regulatory costs or if no SERC is required, the information expressly relied upon and described herein: repeal of these rules will not have an adverse impact or increase regulatory costs on any entity.

    Any person who wishes to provide information regarding a statement of estimated regulatory costs, or provide a proposal for a lower cost regulatory alternative must do so in writing within 21 days of this notice.
