    11B-27.00213Temporary Employment Authorization.

    NOTICE IS HEREBY GIVEN that on November 23, 2016, the Criminal Justice Standards and Training Commission received a petition for a temporary waiver of paragraph 11B-27.00213(4)(b), F.A.C., from Janeen Patterson. Petitioner wishes to temporarily waive that portion of the Rule that states: Agencies applying to temporarily employ or appoint an individual who has had a previous TEA registered with the Commission in the same discipline may do so only if: (a) the individual was previously certified as a full-time or part-time officer; or (b) The individual was previously hired on a TEA and has separated from the employing agency or discontinued training while in good standing, and has had a break-in-service from the last employment for a minimum of four years. Specifically, Petitioner seeks a second TEA without a four-year break in service. Petitioner obtained employment under a TEA in November of 2015 and entered her first training program in March of 2016. Shortly thereafter, Petitioner learned she was pregnant. Petitioner alleges that her pregnancy adversely impacted her performance in a firearms course, causing Petitioner to fail to complete the training program, after which she was terminated from employment. Petitioner alleged that she has suffered a financial hardship and is seeking a second TEA to fund her training.
