11B-35.002Basic Recruit Training Programs for Law Enforcement, Correctional, and Correctional Probation.
NOTICE IS HEREBY GIVEN that on November 17, 2016, the Criminal Justice Standards and Training Commission received a petition for a permanent waiver of subsection 11B-35.002(2), F.A.C., from Chief Christopher Velasquez of the City of Lake Wales Police Department on behalf of Peter Zeman. Petitioner wishes to permanently waive that portion of the Rule that states: Within four years of the beginning date of a Commission-approved Basic Recruit Training Program, an individual shall successfully complete the program, achieve a passing score on the applicable State Officer Certification Examination pursuant to Rule 11B-30.0062, F.A.C., and gain employment and certification as an officer. Petitioner states that, between July 10, 2012, and March 9, 2013, Mr. Zeman successfully completed a Commission-approved Basic Recruit Training Program and received a passing score. Petitioner further states that on March 26, 2013, Mr. Zeman achieved a passing score on the State Officer Certification Examination. Mr. Zeman then sought employment with Petitioner and was ultimately hired by Petitioner on November 7, 2016, after completing the requisite pre-employment screening. According to Petitioner, an oversight on the part of Petitioner led to the failure of Petitioner to hire Mr. Zeman prior to Mr. Zeman’s July 10, 2016, hiring deadline. The Petitioner asserts that Mr. Zeman would suffer an economic hardship should the waiver not be granted, as Mr. Zeman would be required to forego employment and pay for and complete a basic trianing program, the State Officer Certification Examination, and a second round of pre-employment screening.
