    PURPOSE AND EFFECT: To set forth in rule Florida’s core standards for effective educators. The accomplished practices form the foundation for the state’s teacher preparation programs, educator certification requirements and school district instructional evaluation systems

    SUMMARY: The rule will be updated to reflect new statutory requirements outlined in House Bill 1557, effective July 1, 2022, and align additional language about the state academic standards. Effective educator practices will be expanded to include the creation of a classroom environment where students can demonstrate resiliency and promote critical thinking, as well as clarification that the professional and ethical conduct of an educator includes parental notification.

    SUMMARY OF STATEMENT OF ESTIMATED REGULATORY COSTS AND LEGISLATIVE RATIFICATION:

    The Agency has determined that this will not have an adverse impact on small business or likely increase directly or indirectly regulatory costs in excess of $200,000 in the aggregate within one year after the implementation of the rule. A SERC has not been prepared by the Agency.

    The Agency has determined that the proposed rule is not expected to require legislative ratification based on the statement of estimated regulatory costs or if no SERC is required, the information expressly relied upon and described herein: The proposed rule is not expected to have any adverse impact on economic growth or business competitiveness, or increase regulatory costs or any other factor set forth in s. 120.541(2), F.S., and will not require legislative ratification. This is based upon the nature of the proposed rule, which updates the existing standards for effective educators and experience with similar changes in the past.

    Any person who wishes to provide information regarding a statement of estimated regulatory costs, or provide a proposal for a lower cost regulatory alternative must do so in writing within 21 days of this notice.

    6A-5.065 The Florida Educator Accomplished Practices.

    (1) Purpose and Foundational Principles.

    (a) No change.

    (b) Foundational Principles. The Accomplished Practices are based upon and further describe four (4) three (3) essential principles:

    1. through 4. No change.

    (2) The Florida Educator Accomplished Practices. Each effective educator applies the foundational principles through six (6) Florida Educator Accomplished Practices. Each of the practices is clearly defined to promote a common language and statewide understanding of the expectations for the quality of instruction and professional responsibility.

    (a) Quality of Instruction.

    1. Instructional Design and Lesson Planning. Applying concepts from human development and learning theories, the effective educator consistently:

    a. Aligns instruction with state-adopted standards taking into consideration varying aspects at the appropriate level of rigor and complexity;

    b. through f. No change.

    2. The Learning Environment. To maintain a student-centered learning environment that is safe, organized, equitable, flexible, inclusive, and collaborative, the effective educator consistently:

    a. through g. No change.

    h. Adapts the learning environment to accommodate the differing needs and diversity of students; and,

    i. Utilizes current and emerging assistive technologies that enable students to participate in high-quality communication interactions and achieve their educational goals; and,.

    j. Creates a classroom environment where students are able to demonstrate resiliency as outlined in Rule 6A-1.094124, F.A.C.

    3. Instructional Delivery and Facilitation. The effective educator consistently utilizes a deep and comprehensive knowledge of the subject taught to:

    f. Employ questioning that promotes critical thinking higher-order questioning techniques;

    g. through j. No change.

    4. No change.

    (b) Continuous Improvement, Responsibility and Ethics.

    1. Continuous Professional Improvement. The effective educator consistently:

    a. through f. No change.

    2. Professional Responsibility and Ethical Conduct. Understanding that educators are held to a high moral standard in a community, the effective educator fulfills the expected obligations to students, the public and the education profession and adheres to:

    a.Gguidelines for student welfare adopted pursuant to Section 1001.42(8), F.S., including the requirement to refrain from discouraging or prohibiting parental notification of and involvement in critical decisions affecting a student’s mental, emotional, or physical health or well-being, unless a reasonably prudent person would believe that disclosure would result in abuse, abandonment, or neglect as defined in Section 39.01, F.S.

    b.Tthe rights of students and parents enumerated in Sections 1002.20 and 1014.04, F.S.,; and,

    c. Tthe Principles of Professional Conduct of the Education Profession of Florida, pursuant to Rule 6A-10.081, F.A.C., and fulfills the expected obligations to students, the public and the education profession.
