The Department of Children and Families hereby gives notice:
On December 20, 2024, the Department issued an Order Denying Waiver to Metro Treatment of Florida, L.P. The Petition sought a waiver of Rule 65D-30.0142(1)(h)2., Florida Administrative Code, which requires all medication-assisted treatment providers to be open Monday through Saturday. Metro Treatment of Florida requested Saturday closure at 31 clinics throughout Florida based on changes to federal rules that authorized additional take home medications. Petitioner failed to demonstrate the purpose of the statutes underlying the rule would be met by a waiver. Petitioner also failed to demonstrate a strict application of the rule would be a hardship or violate principles of fairness. The Notice of Petition for Waiver was published on August 15, 2024, in Volume 50, Number 160 of the Florida Administrative Register. No comments were received.
