NOTICE IS HEREBY GIVEN that the Division of Florida Condominiums, Timeshares, and Mobile Homes, Department of Business and Professional Regulation, State of Florida has received the petition for declaratory statement from Howard J. Perl, Esq., In Re: Birch Crest Apartments, Inc., Docket No. 2012051493, filed on December 14, 2012.The petition seeks the agency's opinion as to the applicability of section 718.104(4)(f) and (g), Florida Statutes as it applies to the petitioner.
Whether Birch Crest Apartments, a condominium, may assess unit owners in their percentage share of common expenses or in the amount of rent for the ground lease set out in the declaration of condominium under section 718.104(4)(f) and (g), Florida Statutes.
