    NOTICE IS HEREBY GIVEN that the Department of Financial Services, Division of State Fire Marshal (Department), has issued an order disposing of the petition for declaratory statement filed by Dale E. Fey, Jr., Fire Marshal, North Collier Fire District (Petitioner) on September 26, 2016. The following is a summary of the agency's disposition of the petition:

    The Petition seeks the agency’s opinion as to whether the language of s. 633.202(19), Florida Statutes modifies or changes the requirement for area of refuge in the Florida Fire Prevention Code. The Department’s response is the language of section 633.202(19), Florida Statutes, effectively changes the requirements for an area of refuge in each structure from the FFPC, 5th Edition, to the requirements of the Florida Building Code, Accessibility.
