NOTICE IS HEREBY GIVEN THAT the Department of Agriculture and Consumer Services has received the petition for declaratory statement from Calder Race Course, Inc. and Tropical Park, Inc. The petition seeks the agency's opinion as to the applicability of Section 849.094, F.S., as it applies to the petitioner.
Petitioners are licensed pari-mutuel facilities who are requesting a formal determination from the Department that the provisions of Section 849.094, F.S., do not apply to Petitioner’s marketing promotions offered to patrons of the facilities.
