    PURPOSE AND EFFECT: The purpose and effect of the proposed rule amendment is to provide for establishment of fees for Tier II public recreational opportunities consistent with the management plan and the recreation master plan on the Babcock Ranch Preserve pursuant to s. 259.1053(5), F.S.

    SUMMARY OF STATEMENT OF ESTIMATED REGULATORY COSTS AND LEGISLATIVE RATIFICATION:

    The Agency has determined that this will not have an adverse impact on small business or likely increase directly or indirectly regulatory costs in excess of $200,000 in the aggregate within one year after the implementation of the rule. A SERC has not been prepared by the Agency.

    The Agency has determined that the proposed rule is not expected to require legislative ratification based on the statement of estimated regulatory costs or if no SERC is required, the information expressly relied upon and described herein: The nature of the rule and the preliminary analysis conducted to determine whether a SERC was required.

    Any person who wishes to provide information regarding a statement of estimated regulatory costs, or provide a proposal for a lower cost regulatory alternative must do so in writing within 21 days of this notice.

    THE FULL TEXT OF THE PROPOSED RULE IS:

    68A-9.004 Permits for Hunting or Other Recreational Use on Wildlife Management Areas.

    (1) In addition to other licenses, permits and stamps required by law, stamp requirements for hunting, camping, fishing, or other recreational uses on lands owned, leased or managed by the Commission or the State of Florida for the use and benefit of the Commission shall be as provided by Sections 379.354(8)(g) and (h), F.S.

    (a) The cost of permits as required for hunting on wildlife management areas as provided by Section 379.354(8)(g)1., F.S., shall be $25.

    (b) The cost of permits for Tier II public recreational opportunities on the Babcock Ranch Preserve shall be established by order of the Executive Director, to capitalize on the value of hunting on portions of the preserve and to help ensure the preserve is financially self-sufficient, as required by Section 259.1053(5), F.S.
