NOTICE IS HEREBY GIVEN that Building Code Administrators and Inspectors Board has issued an order disposing of the petition for declaratory statement filed by John C. Kinstle on August 2, 2019. The following is a summary of the agency's disposition of the petition: The Notice of the Petition was published in Volume 45, No. 170, of the August 30, 2019, issue of the Florida Administrative Register. Petitioner sought the Board’s opinion as to subsection 468.602(2), F.S., if a Certified General Contractor fell under the statutory exemption and is therefore authorized to act as a licensed building inspector without any further testing or licensing requirements. The Board reviewed the Petition for Declaratory Statement at its meeting held on October 17, 2019 in Orlando, FL. The Board’s Order filed on November 20, 2019 declines to answer the Petition for Declaratory Statement in that to do so would be beyond its authority in that it would require an analysis of Title XXXII Chapter 489.

A copy of the Order may be obtained by contacting Krista Woodard, Executive Director, Building Code Administrators and Inspectors Board, 2601 Blair Stone Road, N12, Tallahassee, FL 32399-0790, (850)717-1394 or electronic mail – Krista.Woodard@myfloridalicense.com.
