    PURPOSE AND EFFECT: The Commission proposes repeal of the rules in order to dissolve the District in response to a request of the District Board and consent of the sole landowner within the District.

    SUMMARY: White’s Ford Timber, LLC, (“sole landowner”) requests repeal of Rule Chapter 42RRR-1, to dissolve the Big Island Community Development District (“Big Island Creeks CDD” or “District”). The Big Island CDD was originally created by the Commission in June 2018 through adoption of Rule Chapter 42RRR-1 setting forth the name, boundaries, and initial board of supervisors of the District. The District consists of approximately 5,701 acres of land located entirely within the unincorporated boundaries of St. Johns County and has been inactive since establishment. The sole landowner within the District has either filed consent documents or letters of no objection to the dissolution of the District.

    SUMMARY OF STATEMENT OF ESTIMATED REGULATORY COSTS AND LEGISLATIVE RATIFICATION:

    The Agency has determined that this will not have an adverse impact on small business or likely increase directly or indirectly regulatory costs in excess of $200,000 in the aggregate within one year after the implementation of the rule. A SERC has not been prepared by the Agency.

    The Agency has determined that the proposed rule is not expected to require legislative ratification based on the statement of estimated regulatory costs or if no SERC is required, the information expressly relied upon and described herein: The rules are currently obsolete as the District has been inactive since establishment.

    Any person who wishes to provide information regarding a statement of estimated regulatory costs, or provide a proposal for a lower cost regulatory alternative must do so in writing within 21 days of this notice.
