The Department of Agriculture and Consumer Services hereby gives notice: The Department received a Petition for Variance on September 16, 2024 from Anthony Martinez for a variance from the definition of "approved source" as it relates to the water source for bottled water in 21 CFR 129.3 which is adopted by reference in rule 5K-4.002, Florida Administrative Code. Notice of the Petition was published on October 1, 2024 in Volume 50, Number 192 of the Florida Administrative Register. An order denying the Petition for Variance was entered on December 5, 2024. The Variance was denied because the Department does not have authority to issue a variance for statutory or federal requirements.
