The Board of Medicine hereby gives notice that it has received a Petition for Declaratory Statement filed on behalf of Edward Lazzarin, M.D., on February 17, 2008. The Petitioner seeks the Board’s interpretation with regard to whether the Petitioner’s proposed arrangement with regard to opening a physical therapy clinic as outlined in the Petition violates the Florida Patient Self-Referral Act, as set forth in Section 456.053, F.S. The Board will consider this petition at its meeting scheduled for April 5, 2008, in West Palm Beach, Florida.
