    NOTICE IS HEREBY GIVEN that the Division of Florida Condominiums, Timeshares, and Mobile Homes, Department of Business and Professional Regulation, State of Florida, has received the petition for declaratory statement from Michael J. Day, Unit Owner, In Re: The Island Place at Cedar Key Condominium Owner’s Association, Inc., Docket No. 2016006402, filed on February 8, 2016. The petition seeks the agencys opinion as to the applicability of 718.112(2)(c), Florida Statutes, as it applies to the petitioner.

    Whether the Association’s January 2016 amendment to the Bylaws to adopt “Section 5.28” is an illegal and invalid amendment pursuant to Section 718.112(2)(c), Florida Statutes?
