65G-2.015:Siting

The Agency for Persons with Disabilities hereby gives notice:

On February 8, 2018, the Agency issued a Final Order in response to a Petition for a Waiver filed by Vantrease Blair of Russell Home for Atypical Children, Inc. Petitioner on December 16, 2017. The Petition was published Florida Administrative Register on December 20, 2017.

The Final Order hereby grants the Petitioner's waiver from the following paragraphs:

65G-2.007(3)(a) FAC that states that a minimum of 35 square feet of combined living and dining area to be provided for each household member;

65G-2.007(4)(a) FAC which states that a kitchen in each residence shall be large enough to accommodate the equipment and personnel needed to prepare and properly serve the required number of meals;

65G-2.007(5)(b) FAC which states that a maximum of two residents may share a bedroom;

65G-2.014(4), FAC which states that only one facility may be sited on a single parcel of land;

The Petitioner presented competent, substantial evidence to support permanent waiver from the rules referenced.
