NOTICE IS HEREBY GIVEN that the Florida Building Commission has received the petition for declaratory statement from The Plaza Beach Motel, Inc. The petition seeks the agency’s opinion as to the applicability of Section 553.73(10)(i), Florida Statutes, and Section 102.2(h), Florida Building Code, Building (2017) as it applies to the petitioner.

Petitioner seeks clarification about whether placing non-wood items underneath a chickee constitutes incorporating them into the chickee, and whether the use of a chickee is considered when determining whether it is exempt from the requirements of the Florida Building Code.
