    PURPOSE AND EFFECT: Section 633.202(1), F.S., requires the Division of State Fire Marshal to adopt, by rule, the Florida Fire Prevention Code (FFPC). This rulemaking will amend sections of the FFPC that incorporate the National Fire Protection Association’s (NFPA) Standard 1 and NFPA Standard 101 to remove sections of each document related to refuse and trash in doorsteps and means of egress and sections related to structural components of buildings dealing with falls. This rule amendment will update the FFPC related to the NFPA Standard 1, Section 10.18.4 – Means of Egress and Sections 11.10.1 and 11.10.1.1 – Two-way radio Communication Enhancement Systems; and the NFPA Standard 101, Sections 24.2.8, A24.2.8, 12.2.1.2, 14.2.1.5, 16.2.1.1, 26.2.4, 28.2.1.4, 30.2.1.3, 32.2.2.7, 32.3.2.1.3, 36.2.1.6.1, 36.2.1.6.2, 38.2.1.5.1, 38.2.1.5.2, 40.2.1.3, and 42.2.1.3 – Grab Bars, pursuant to Section 633.202(5)(a), F.S., and make other required updates.

    SUMMARY: This rulemaking will update the NFPA Standards 1 and 101 to update language regarding accumulation of refuse at entrances and exits and it will update NFPA sections regarding structural components of buildings.

    SUMMARY OF STATEMENT OF ESTIMATED REGULATORY COSTS AND LEGISLATIVE RATIFICATION:

    The Agency has determined that this will not have an adverse impact on small business or likely increase directly or indirectly regulatory costs in excess of $200,000 in the aggregate within one year after the implementation of the rule. A SERC has not been prepared by the Agency.

    The Agency has determined that the proposed rule is not expected to require legislative ratification based on the statement of estimated regulatory costs or if no SERC is required, the information expressly relied upon and described herein: The Department’s economic review for this rulemaking.

    Any person who wishes to provide information regarding the statement of estimated regulatory costs, or to provide a proposal for a lower cost regulatory alternative must do so in writing within 21 days of this notice.
