NOTICE IS HEREBY GIVEN that the Department of Financial Services has issued an order disposing of the petition for declaratory statement filed by Petitioner Choice Plus LLC on January 17, 2014. The following is a summary of the agency’s disposition of the petition:

A Response to Petition for Declaratory Statement, Case No. 147680-14-DS, in reference to the Petition for Declaratory Statement has been issued. The Notice of Petition for Declaratory Statement was published February 10, 2014, in the Florida Administrative Register. The Petitioner sought an opinion as to the applicability of Sections 120.565 and 717.126, Florida Statutes, and the Florida Administrative Code, as it relates to the provision of the Florida Disposition of Unclaimed Property Act, Chapter 717, as it applies to Choice Plus, LLC. The Petition is asking the Department to define the term “good cause”. Choice Plus, LLC has also filed a mandamus action with the First District Court of Appeal, still pending; Case No. 1D14-0124, involving the same matter. Due to pending litigation on this matter with the First District Court of Appeal, the Department declines to address the Petition for the reasons noted in the Response.
