NOTICE IS HEREBY GIVEN that the Division of Florida Condominiums, Timeshares, and Mobile Homes, Department of Business and Professional Regulation, State of Florida, has declined to rule on the petition for declaratory statement filed by Christopher M. Cobb, Esq., In Re: The Grand Reserve Condominium Association, Inc., Docket No. 2014043952, on October 20, 2014. The following is a summary of the agency’s declination of the petition:
The division declines to issue a Declaratory Statement because the question centers on the applicability of a doctrine created by case law and not found in any statutes, rules or orders over which the agency has authority; the questions or doubts raised by the association’s particular circumstances are not related to the applicability of statutes, rules, or orders over which the division has authority; and a declaratory statement may not be used to determine the conduct of another person. The order was filed with the Agency Clerk on February 12, 2015.
