The Board of Acupuncture hereby gives notice of the issuance of an Order regarding the Petition for Waiver or Variance, which was filed on November 5, 2014, by Dan Maurice Cohen. The Notice of Petition for Waiver or Variance was published in Volume 40, Number 229, of the November 25, 2014, Florida Administrative Register. The Petitioner was seeking a waiver or variance of Rules 64B1-4.001 and 64B1-4.011, F.A.C., in regards to 64B1-4.001, F.A.C., the requirement that an applicant must establish that he or she has completed an acupuncture program of coursework and clinical experience that meets the rule requirements, including submission of official transcripts from the institutions at which the requirements were completed, along with the requirement that applicants must establish completion of 60 college credits from an accredited college by submitting official transcripts. The Board considered the instant Petition at a duly-noticed meeting, held December 12, 2014, in Orlando, Florida.

The Board’s Order, filed on January 22, 2015, grants the waiver of Rules 64B1-4.001 and 64B1-4.0011, F.A.C. The Board finds that Petitioner met the purpose of the underlying statute by other means and has otherwise shown a substantial hardship and that application of the rule at issue to Petitioner would violate principles of fairness.
